1. Acceptance of Terms
By accessing or using the OpticCPG analytics platform at https://app.opticcpg.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
2. Description of Service
OpticCPG is a business analytics platform for consumer packaged goods (CPG) brands. The Service connects to your e-commerce and advertising accounts (Shopify, Amazon, Meta Ads, Google Ads) via OAuth to aggregate and display sales, retention, and marketing performance data in a unified dashboard.
3. Account Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@cpgplaybook.co if you suspect unauthorized access to your account.
4. Authorized Use
You agree to use the Service only for lawful business purposes. You may not:
- Use the Service to access data you are not authorized to access
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service in any way that could damage, disable, or impair the Service
- Attempt to gain unauthorized access to any systems or networks connected to the Service
- Use automated means to access the Service in a manner that exceeds reasonable use
5. Third-Party Integrations
The Service connects to third-party platforms including Shopify, Amazon, Meta, and Google. By connecting these platforms, you authorize OpticCPG to access the data specified in the OAuth consent screen on your behalf. You are responsible for ensuring you have the right to authorize such access and that your use complies with each platform’s terms of service.
OpticCPG is not affiliated with, endorsed by, or sponsored by Shopify, Amazon, Meta, or Google.
6. Your Data
You retain ownership of all data you connect to or upload into the Service. By using the Service, you grant OpticCPG a limited license to access, process, and display your data solely for the purpose of providing the Service to you. We do not claim ownership of your data and will not use it for any purpose other than providing and improving the Service.
7. Intellectual Property
The Service, including its design, software, and content (excluding your data), is the property ofOpticCPG and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will be accurate or complete.
9. Limitation of Liability
To the maximum extent permitted by applicable law, OpticCPG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amounts you paid to us in the twelve months preceding the claim.
10. Termination
You may stop using the Service at any time. We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without notice, if we believe you have violated these Terms or for any other reason. Upon termination, your right to use the Service ceases immediately, and we will delete your data in accordance with our Privacy Policy.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or via a notice in the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the applicable courts.
